1. Introduction

Welcome to CGMist. We are dedicated to providing high-performance, cost-effective rendering solutions using state-of-the-art RTX hardware. By accessing or using our website and rendering services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

2. Services Provided

CGMist provides a cloud-based rendering service ("SaaS"). We utilize high-performance third-party infrastructure to process your 3D scenes.

• Compute: GPU processing is provided via RunPod.
• Storage: File storage is provided via Backblaze B2.

By using our service, you acknowledge and agree that your data will be processed and stored on this third-party infrastructure.

3. Account & Credits

• You are responsible for maintaining the confidentiality of your account credentials.
• CGMist operates on a pre-paid "Wallet" system. Credits purchased are non-transferable.
• We reserve the right to terminate accounts that violate these terms or engage in illegal activity.

4. User Content & Confidentiality

Your Rights: You retain full ownership and copyright of all files (.blend files, textures, assets) you upload and the resulting renders.

Confidentiality: CGMist agrees to keep all user projects, assets, and renders confidential. We will not use, publish, or share your work without your explicit written permission.

Prohibited Content: You may not render content that is illegal under Indian law, including CSAM or content that promotes terrorism.

5. Data Retention

To manage storage costs and user privacy, source files and rendered output are automatically deleted from our servers 7 days after job completion. CGMist is not responsible for data loss if you fail to download your files within this window.

6. Limitation of Liability

CGMist strives for 99.9% uptime, but we rely on third-party providers (RunPod/Backblaze).

• CGMist is not liable for render failures caused by third-party server outages, hardware crashes, or data corruption.
• In the event of a system failure, our liability is strictly limited to refunding the credits used for that specific failed job.
• We are not liable for missed deadlines, lost profits, or consequential damages arising from the use of our service.

7. Governing Law

These Terms shall be governed by and defined following the laws of India. CGMist and yourself irrevocably consent that the courts of Hooghly, West Bengal shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
